My mother-in-law is seeing a guy that has been married for over 20 years, he hasn't seen or spoken to hes wife in at least 19 years he says and has no way of getting in touch with her, they were married in California. Is there a paper of some kind he can sign to have the marrage ended without the wifes signature??How do you go about getting a divorce after being split up for over 20 years?
He goes to the local family court and files for ';an alienation of affections'; style divorce. In that writ, he states the amount of time separated and the lack of contact. Then, sends the papers to her last known address, registered mail with return receipt required. Or he can track her down by her social security number possibly to find out where she is, if working, and send it to her there. Your state may not even require all this if he can prove the alienation has been for that long a period, if he has friends to testify to it.How do you go about getting a divorce after being split up for over 20 years?
Yes of course or no one would be able to be divorced - it will take longer - he still needs to get a lawyer - last known address of separated wife and any family members - they will send them a registered letter informing them of her address and his intentions - he will also have to pay to put an ad in those local newspaper filing for divorce action - there will be a wait period and if no response it will be finalized.
All divorce lawyers no how to obtain a divorce when this happens.
It happens more than people think.
He should get a lawyer and let him/her take care of it.
Some states allow you to file for divorce even after so many years with out consulting with your ex.
Believe me he could get in touch with her if he wanted.
