Laws and rights of same sex parents splitting up in england?

If you are ';married'; as in the civil partnership then the statutory provision is set out. If you are not married then there is no common law or statutory provision. Custody of the child is a separate issue. Often confused. the courts aren't interested in the rights of the person. Its the Child's interests that are supposed to be protected. often poorly done but more-so the blame of the parents. its always a sad situation.

One of the couple is the husband and the other the wife. I don't think that a judge will care which is which and will award the child to the one who he/she thinks is most qualified to rear the child. At least I hope so. One of the match may not want the child so it would go to the other one. If the child is not wanted by either parent then the child will be sent to a home for adoption. I pity the poor child. It is the children who always get hurt. The direct reply to your question is that both parties have equal rights whatever they may be in England.
It's analyzed like any other divorce. The law applied is similiar to that of a business partnership dissolution. If there are children, the Court looks at the best interest of the child. Both child support and visitation are permitted. Assets and debts are tried to be divided equally, based upon income.
You can,t have the same sex parents .


And my personal view is that it should not be allowed for gays to bring up children ,for the children grow up thinking that is the norm
